discolé monade Posted February 23 Posted February 23 First, I want to start by talking about the fact that Luigi Mangione remains in federal custody where he is being prosecuted in three jurisdictions: by the federal government, by New York State, and by Altoona, Pennsylvania, but he is being held in federal custody and the Department of Justice has refused to allow him to be in State custody, despite the fact that they’ve all agreed that the State court is going to go first. the team has an entire site dedicated to their client. interesting. 3 Quote
André Toulon Posted February 26 Posted February 26 Not to be that guy, and I'm not sure if this is everywhere or state by state but in some places, from what I understand, violent suspects don't have to be mirandized. 4 Quote
discolé monade Posted February 26 Posted February 26 no, AND if they started questioning him at the time of approach and beginning of search...then yes, they fucked up. on base...i didn't care WHAT was happening...the MINUTE we decided to arrest. that miranda came flooding out. If they do not plan to interrogate you at the time of arrest, they do not have to Mirandize you. However, if they ask you any questions about the alleged crime before informing you of your Miranda rights, your attorney can have any subsequent evidence they gained invalidated. 3 Quote

I actually have this exact experience but wasn't going to post that as the norm because I know the law doesn't apply to me....I thought I was so smart representing myself to the judge on the TV and they were like 🤷🏿♂️....you been in there for 7 days, time served and here's your fine....when you paying that shit? Yeah my public defender said that was TV shit. It could very well be a violation of our rights but it doesn’t matter. Idk if there’s a fine print to the law plebs like us don’t know about, or what, but getting arrested and thinking “no one read my Miranda rights” as a means for getting charges dismissed is fantasy in most cases 2 1 Quote
discolé monade Posted February 27 Posted February 27 oh...again. this was on base. all laws of any current state would apply except for x,y,z out in the real world. yeah...i guess i was thinking that the mcdonalds would have audio/video, which might be more credible. i forget how fucking naive i can be, even though i have experienced some fucked up cop situations as a civilian. 3 Quote

Maybe the military always reads Miranda rights? Don’t feel bad about being naive. I am too about shit. I had to get an affirmation notarized to renew my license. When I notarized documents I don’t charge for it. It’s $2, I figure fuck it, but ofc I don’t expect to not be charged but I expect to be charged $2. Bitch charges me $5. I told her “whaddya mean, five dollars?!?” She asked me with fuckin attitude “why, how much do you have?” “I’m a notary. You notarized an oath of affirmation for renewal, you know I know you can only charge $2” long story short I threw the $5 at her after she rolled her fuckin eyes st me that second time 2 Quote

It was on the ID channel. Came out about 6 weeks ago. I don’t think he’s got a leg to stand on about them taking his DNA without consent. Courts usually say it’s fine to trick a suspect with lies and hospitality. Anything he throws out is fair game. Diddy apparently hates Mangione because he gets too much attention 😆 5 Quote

1pooh4u Posted 11 hours ago Author Posted 11 hours ago AG Bondi seeking the death penalty for Mangione. Ok. Good luck with that. He’s not the worst of the worst. That’s what the death penalty is supposed to be reserved for the absolute worst offenders in existence. This is just to make the disgustingly rich feel safer. They have no right to safety. 1pooh4u Posted 11 hours ago Author Posted 11 hours ago I wonder when Bondi is going to try and move the case to a more conservative state. It’s gonna be hard finding a jury in NYC unanimously voting to put him down. 3 Quote
