Have Disney+? You cant sue Disney if you die at their property

Is that hyperbole? Yea, a bit, but thats basically what the Disney lawyers are currently arguing in court.

Disney is currently arguing that because someone who died at one of their properties agreed to the Disney+ terms and conditions they cannot bring a lawsuit against Disney and must instead go through binding arbitration.

No, Im not kidding.

"Disney is asking a Florida court to dismiss a lawsuit brought against it by Jeffrey Piccolo, the husband of Kanokporn Tangsuan, a family medicine specialist with NYU Langone’s office in Carle Place, on Long Island.

The company argues Piccolo had agreed to settle any lawsuits against Disney out of court through the arbitration process when he signed up for a one-month trial of Disney+ in 2019 and acknowledged that he had reviewed the fine print.

“The Terms of Use, which were provided with the Subscriber Agreement, include a binding arbitration clause,” the company wrote in its motion. “The first page of the Subscriber Agreement states, in all capital letters, that ‘any dispute between You and Us, Except for Small Claims, is subject to a class action waiver and must be resolved by individual binding arbitration’.”"

 

This is absurd on its face and should be thrown out. If not we are even more fucked that we currently are.

On the plus side, the Human-CentiPad might be real

This is the equivalent of 'According to our records, you bought a 6 pack of underwear on Amazon using a Visa card 10 years ago and the fine print specifically states the word 'the' more than once in a single sentence so, no you can't sue us for having a limb chopped off when our carnival ride held together with duct tape and gumption gave out.'

I feel like multiple courts have already ruled that those sorts of ToS/EULA things we're all forced to click through aren't even legally enforceable in most cases. Not that this will stop another court from ignoring precedent.

Unfortunately, "Mickey Mouse made of hotdogs and the hotdogs have 2 meatballs attached on one end" was too complicated.

Try carnival made of penises or something. 

'Disney' might be getting caught by the AI nope filter but generalize it to the things that Disney is and you'll probably get all sorts of horribles.
