It’s entirely a zoning issue, which is more about competition between business types and traffic flow (both foot and vehicle).  Small municipalities have a lot of leeway in determining what businesses can open in commercial zones, which is code for who’s paying off a local planning commissioner.  Lawsuits like this are intended to force cities to be more precise about how they determine business zones.

i wanted to say something clever. but the fact that a court, had to take time out, and rule that these tacos and burritos

were in fact made to order, and to allow a hispanic man to sell his food. 

it has nothing to do with 'sandwiches', and more to do with racist folk don't want mexico in their town. 

"Bobay said the commission can appeal the ruling." and they will.

Well New York City for better or worse has a shitload of expats, hence the tacos places every other block.
