On a bumpy, overcrowded city bus, 63-year-old janitor Kenny squints at his phone, trying to send a text to his brother, Roger, confirming their Thanksgiving dinner plans. Suddenly, the bus hits a massive pothole, causing Kenny’s thumb to fumble—and, somehow, the worst happens. Instead of sending a “See you at 3!” message, Kenny mistakenly sends a recently taken, unflattering photo of his junk.

Moments later, Roger calls, furious.

“Kenny, what the hell is wrong with you?”

“Roger, listen! The bus hit a bump! The phone jumped outta my hand, and my thumb—”

“What bump causes that kind of mistake?!”

“Technology, Rog! These phones got a mind of their own!” Kenny stammers. “It’s the touchscreen! It’s...it’s too sensitive!”

“You were already looking at that picture?! Why?! Why did you even take it?!”

“Uh...I was trying to document, uh, something. For medical reasons!” Kenny blurts out.

“Oh, come on!” Roger shouts.

“Think about it, Rog,” Kenny pleads. “A bus ride is like life—it’s bumpy, unpredictable, and sometimes it sends you in the wrong direction. My thumb was just a casualty of the road, man!”

“Don’t try to get poetic about this, Kenny. You’re not coming to Thanksgiving.”

“Rog, you can’t do that! It was an accident! Like dropping your turkey on the floor—”

“Stop talking.”

The call ends, leaving Kenny sitting on the bus, shaking his head and muttering, “Damn touchscreens...” as passengers around him slowly scoot farther away.

I love how the AI renamed Kenny, Walt for a second there 😆

lol, I didn't specify the name of the janitor. I had to change the Walts to Kennys and I missed a few. I think the AI did a pretty good job. I told it to create a stupid metphor that pissed his brother off.

I just never really got this argument. I'm sure a movie director might get upset that footage of their film was used in a negative review, but it's not their right to stop someone from using it in a transformative way. The author doesn't own how people use their art in their own time. The director doesn't get to burst into my house and scream at me to stop pausing so often, so why should self-entitled artists get to control images that are unrecognizable from the original?

You’re joking right?  The second half of your argument has got to be a joke.

You pausing a film on your device is not the same as ripping shots directly with no change. Now using images created by someone else or ripping their art off wholesale, and they make their living off their art, just so people can have a guffaw is just not art.  It’s not art that has entered the public domain. You’re not creating something new out of the piece with your own original work. It’s all stolen and it doesn’t make someone “entitled” to not want the work they created to be used by AI.

The more important part was the director not wanting footage used for a negative review. Can the director just ban their footage from reviews posted to Youtube?

The answer, by the way, is literally no. If they put a copyright strike on it, it's a crime because it is protected by Fair Use and false strikes are not legal. Doesn't stop people, but it's protected. What we do all day, spamming memes we found on the internet, is quite literally more theft than what you're describing.

As for the pausing movie thing, I was getting at more along the lines of death of the author. Like you can't control the work after it's out in the wild.

The standard doesn't work when applied elsewhere. The plagiarism claim would not hold up in court when the result is completely different from the original.

I'm touchy about the subject because I would like to use it to accommodate disabilities that prevent me from doing art traditionally. I don't have much confidence already without the endless barrage of people effectively saying the only form of art I think I might be able to use will never be good, and being clearly unwilling to have basic conversations about it.

Every time I see it, I'm reminded how useless I am.
