The governor actually added penal language in response to this in his budget amendments this week.

Without doing any research it looks like it is being added to the statutory rape law. So basically if enacted it means if someone is in custody of an officer, they cannot legally consent and it is by definition rape no matter any other circumstances.

Yeah, it happened in NYC and blew up in the news at the same time as the state budget starts getting put together, so even though it's not a fiscal thing the Governor decided to add it in.

And the particular facts of this case have prevented the law from adequately prosecuting the case because the two officers were contesting the victim's absence of consent.

By making this a form of statutory rape, consent is irrelevant to the crime, and it becomes easier to prosecute the defendant charged with the rape of a victim in their custody.

Custody is key, not cuffs. Cuffs are just an indicator of (but not required for) custody. I don't even really understand what you mean.

Simply put, if you are in "detained or in the custody" of an officer, and that officer has sex with you, it would legally be considered a felony rape regardless of whether you wanted to do it or not. Actual, bona fide custody, not an illegal detainment. Like the officer properly arrests you, and then has sex with you.

What you seem to be talking about is a whole different can of worms.
